Several people had challenged this rule asking to strike it down. However, a 3-judge bench of the US Court of Appeals refused to strike the rule down and moved it to lower court to remand and give the district court a chance to assess and determine the merits.
Accordingly, we reverse the district court's grant of summary judgment and remand for further proceedings consistent with this opinion," said the court.
This has given a temporary relief for Indians working in the USA as they can now remain the country and work which wouldn't have happened had the rule been struck down, reports TOI.
